Article 2: Scope of application
These General Conditions of Sale apply to all orders placed on the Calvados Christian Drouin website and for all orders received by fax, mail or telephone, regardless of the clauses that may appear on the buyer's documents.
By placing an order, the customer acknowledges having read and accepted the present General Terms and Conditions of Sale. In the event of a case not covered by these General Terms and Conditions of Sale, the distance selling rules of the place where the company has its registered office shall apply. The present contract is governed by French law.
Article 3: Ordering
Calvados Christian Drouin undertakes to accept orders placed via the Internet under the terms of these General Terms and Conditions of Sale and within the limits of available stocks.
In case of stock shortage, we will inform you of the waiting time required to obtain the desired product or we will offer you a replacement product. Orders will be shipped in a single delivery.
By validating the order, the customer declares to have read and accepted the present General Terms and Conditions of Sale.
Any order will be taken into consideration only after receipt of payment and will be confirmed by sending an email.
Calvados Christian Drouin reserves the right to cancel all orders, non-compliant or questionable, as well as those from a customer with whom there is any dispute.
Article 4: Prices
The prices indicated are expressed in euros and are inclusive of all taxes (applicable VAT, excise duties and any other applicable taxes). The displayed prices do not include the participation in the shipping and delivery costs.
These shipping and delivery costs vary according to the weight of the products ordered and the country of destination.
The price indicated in the order confirmation by Calvados Christian Drouin is the final price, expressed all taxes included and including VAT at 20%.
Article 5: Validity of tenders
The products are offered within the limit of available stocks.
Calvados Christian Drouin cannot be held responsible for a possible out-of-stock condition that would lead to a delay in the delivery of the order.
Orders are final only when they have been confirmed by the payment of the price by the buyer.
In case of unavailability of one or more products after the validation of the order, Calvados Christian Drouin undertakes to inform the customer by email as soon as possible. In agreement with the customer, Calvados Christian Drouin may modify the order, or will proceed to the refund of the unavailable product(s) by crediting the payment card that was used when the order was placed.

Calvados Christian Drouin delivers in several European countries.

The delivery time for orders is from 5 to 15 working days for products in stock, after receipt of payment. Non-working days include Saturdays, Sundays and public holidays, as well as days when road transport is prohibited. These periods are indicated in the order confirmation received by e-mail by the customer. The order is delivered to the delivery address chosen by the customer.
Calvados Christian Drouin is committed to doing everything possible to deliver the products ordered as quickly as possible.
Delivery times vary according to the country of destination chosen by the customer.
The delivery is made within the period provided by the direct handing-over of the product to the announced addressee, or in case of absence, by Review making it available.
Calvados Christian Drouin cannot be held responsible for loss, damage, errors or non-delivery of a shipment once the existence of circumstances beyond its control has been established, i.e. :
Cases of force majeure relieving the company Calvados Christian Drouin of its obligation to deliver: war, riots, fire, strikes, natural disasters, earthquakes, floods, road / train / plane accidents, embargoes, the impossibility to be supplied.
Any act, failure or negligence of any third party. For example: the sender, the addressee, any interested third party, any employee of customs or any other administration, the postal services, any carrier or other third party to whom the consignment is entrusted by the transport service provider to serve areas not directly served by itself, even if the sender has not requested or has not been informed of the use of a third party.
The customer is required to carefully check his packages upon delivery in order to immediately express any reservations to the carrier.
The information given by the buyer, when taking an order, is binding on him: in case of error in the wording of the recipient's details, the seller cannot be held responsible for the impossibility of delivering the product.
The bottles calvados are delivered in cartons of 1, 2, 3 or 6 bottles that can be delivered at one time to the same place.
Article 7: Sale abroad
In case of delivery to a country other than metropolitan France, the buyer is deemed to be the importer of the product(s) concerned.
All local taxes, customs duties or other services to be paid are the exclusive responsibility of the buyer. It is the responsibility of the buyer to carry out all formalities and obtain all necessary authorisations for the acquisition of the products from the local authorities and to ensure that the products comply with local legislative and regulatory requirements.
Calvados Christian Drouin advises the buyers to inquire about these obligations with the competent local authorities, prior to any online order on the site www.calvados-drouin-boutique.com.
Article 8: Payment
Payment for products purchased from Calvados Christian Drouin is payable in full at the time of order. The bottles of calvados (and other products sold) remain the property of Calvados Christian Drouin until full payment of the invoices.
Payments can be made by credit card, by check, payable to Calvados Christian Drouin or by bank transfer. An invoice will be established by Calvados Christian Drouin and sent to the customer at his billing address.
Article 9: Right of withdrawal
In application of the provisions of article L221-18 of the Consumer Code, the buyer has a period of fourteen (14) days following receipt of the order to exercise his right of withdrawal, without having to justify a reason and without penalties, except for the return costs, which remain the responsibility of the buyer.
Calvados Christian Drouin undertakes to reimburse the buyer of the product including shipping costs. Reimbursement will be made within two weeks after receipt of the return. In case of exchange of product, the shipping costs of the exchanged product remain the responsibility of the customer.
Returns are made to Calvados Christian Drouin - RD 677 - 14130 COUDRAY-RABUT.
In order to exercise his right of withdrawal, the purchaser must notify his decision by means of a clear and unambiguous statement.
The declaration of withdrawal must include the following mandatory information: name of the purchaser, geographical address and, if applicable, telephone and fax number and e-mail address. If the product has been received by a third party other than the purchaser, the purchaser must indicate the contact details of this third party in the declaration of withdrawal.

Upon receipt, Calvados Christian Drouin SAS will send the buyer, without delay, an acknowledgement of receipt of the withdrawal on a durable medium.
The buyer may not avail himself of his right of withdrawal in the event that the goods in question have been made to the buyer's specifications or clearly personalised or which, due to their nature, cannot be reshipped or are likely to deteriorate or expire rapidly.
The right of retraction cannot be exercised for products that will have been unsealed or opened by the buyer or the recipient of the order after their delivery.
Article 10: Retention of title
The goods delivered will remain our property until they are dispatched when they are handed over to the carrier, once you have paid the price.

The creation of a customer account at Calvados Christian Drouin requires the customer to provide a certain amount of personal data.

The language of this contract is the French language. All clauses of these Terms and Conditions of Sale, all transactions and purchases made from the site www.calvados-drouin-boutique.com and by mail and telephone are governed by French law and law. Any dispute which will not have found an amicable agreement will be under the jurisdiction of the Courts of the registered office of the Company Calvados Christian Drouin.
Article 14: Protection of minors and public health
In accordance with article L. 3342-1 of the Public Health Code, the sale of alcohol to minors under the age of eighteen (18) is prohibited. Any customer of Calvados Christian Drouin undertakes to be at least 18 years old when placing an order with Calvados Christian Drouin.
The seller shall in no way be held liable if a minor customer were to disregard this clause.

Article 15: Disputes
Complaints or disputes will be received with great care. Calvados Christian Drouin presumes the good faith of the client who takes the trouble to state his situation. In the event of a dispute, the client is invited to first contact the company to obtain an amicable solution.
Article 16: Product warranty
The products sold correspond materially to the specifications presented to the buyer by the Online Boutique when they are used in strict conformity with the functions for which they were sold
Unless otherwise provided by law, the liability of Calvados Christian Drouin shall in no case exceed the value of the goods invoiced.
